Where Hiperion provides hosting, forms, storage, or digital infrastructure to a client, the client generally retains ownership and control of its own business information and Client Data.
Hiperion's access to Client Data is limited to what is reasonably required to:
Provide the Services;
Maintain systems;
Troubleshoot problems;
Provide technical support;
Maintain security;
Perform backups where applicable;
Comply with legal requirements; or
Otherwise fulfill the applicable service agreement.
Hiperion does not use Client Data for unrelated purposes merely because the information is stored on Hiperion-managed systems.
The specific responsibilities of Hiperion and the client may also be established in the applicable Terms & Conditions, Proposal, or service agreement.
12. Client Responsibilities
Where Hiperion provides Services to a client that involve collecting personal information from that client's customers, employees, users, or other individuals, the client is generally responsible for:
Determining what information is collected;
Determining the purposes for collection;
Obtaining required consent or authority;
Providing required privacy notices;
Ensuring that its collection and use of personal information complies with applicable law; and
Responding to requests that relate primarily to the client's own collection or use of personal information.
Hiperion will provide reasonable assistance where required as part of the applicable Services.
13. Security
Hiperion uses reasonable technical and organizational measures appropriate to the Services to protect information against unauthorized access, loss, misuse, alteration, or disclosure.
Security measures may include:
Access controls;
Authentication;
System monitoring;
Secure hosting infrastructure;
Software updates;
Security patches;
Backups where applicable;
Restricted administrative access; and
Other reasonable security measures appropriate to the systems involved.
However, no electronic transmission, website, database, or internet-connected system can be guaranteed to be completely secure.
Hiperion cannot guarantee that information will never be accessed, disclosed, altered, lost, or destroyed as a result of circumstances outside Hiperion's reasonable control.
14. Data Retention
Hiperion retains personal information only for as long as reasonably necessary for the purposes for which it was collected, to provide Services, to satisfy contractual obligations, to maintain business records, or as otherwise required or permitted by law.
For Client Data associated with suspended or terminated Services, the applicable Terms & Conditions may provide for a defined retention period.
Unless otherwise agreed in writing, Hiperion may retain Client Data for up to six (6) months following suspension or termination of applicable Services.
After the applicable retention period, Hiperion may permanently delete the information, subject to legal, regulatory, security, accounting, or other legitimate retention requirements.
Clients are responsible for maintaining independent copies of information they require.
15. Data Location and Service Providers
Hiperion may use service providers and infrastructure located in Canada or other jurisdictions.
As a result, information may be processed or stored outside the province or country in which it was originally collected.
Where information is transferred to another jurisdiction, it may be subject to the laws of that jurisdiction.
Hiperion will take reasonable steps appropriate to the circumstances when selecting and using service providers that handle personal information.
16. Access to Personal Information
Subject to applicable law, individuals may request access to personal information about themselves that is held by Hiperion.
A request should include enough information to allow Hiperion to identify the individual and locate the relevant information.

Where information is held by Hiperion on behalf of a client, the request may need to be directed to that client.

Where Hiperion maintains information on behalf of a client, Hiperion may direct the request to the applicable client or assist the client in addressing the request.

Withdraw consent where applicable;
Request deletion where legally available;
Object to certain uses of information; or
